Introduction

Welcome to the APMT - Annapurna™ Resource ("Advanced Predictive Modeling Technology," "APMT," "we," "our," or "us"). These Terms and Conditions ("Terms") govern your use of our software-as-a-service (SaaS) offerings specifically designed for the mining industry, including large mining operations, consulting companies, and independent experts (collectively, the "Service"). By accessing or using the Service, you agree to comply with and be bound by these Terms in their entirety.

Acceptance of Terms

By accessing or using any part of the Service, you signify your acceptance of these Terms, which constitute a binding legal agreement between you ("User" or "you") and APMT. If you do not agree with any provision of these Terms, please discontinue use of the Service immediately. Continued use of the Service following any updates to these Terms shall also constitute acceptance of the new Terms.

Use of Service

The Service is intended for use exclusively by trained professionals within the mining industry. You agree to utilize the Service strictly in compliance with all applicable laws, industry standards, and regulations. Any unauthorized use, reproduction, or exploitation of the Service, including reverse engineering or duplication, is expressly prohibited and may result in immediate termination of your account, along with legal repercussions.

Account Registration

In order to access the Service, you must register for an account. By registering, you agree to provide accurate, current, and complete information as requested, and to update such information to maintain its accuracy. You are responsible for maintaining the confidentiality of your account credentials and will be held accountable for all activities performed under your account. Any misuse or unauthorized access must be promptly reported to us.

Your use of the Service is also governed by our Privacy Policy, which can be found at Privacy Policy. We are committed to safeguarding the data we collect, and any information you provide to us will be used in accordance with our Privacy Policy.

Data Storage and Security

• Platform Database Storage: The platform database is hosted securely on Amazon Aurora RDS, and regular backups are performed on a monthly basis to ensure data integrity and recovery.
• User Data Storage: User data files are stored securely in Amazon S3 buckets with industry-standard encryption and access controls. Users are responsible for their own backups of data files, as APMT does not provide duplicate storage of user data.

Platform Updates

We periodically update the platform for the introduction of new features, bug fixes, and user experience improvements. Users will receive a minimum five-day notice before updates are rolled out, except in critical cases where immediate patches are necessary for security or operational continuity.

Payment

• Modalities: Subscription options include a monthly subscription or a yearly license. For the yearly license option, the user is granted a limited license without further subscription payments for the duration of the license period.
• Duration: Users with an active subscription will retain access to the platform from the effective date of payment until the subscription is terminated or until the fixed-term plan period concludes. Upon termination or expiration of the subscription, access to the Service will be promptly revoked, and APMT shall not be liable for any loss of data or consequences arising thereafter.
• Refunds: All payments made for the Service are considered final and are non-refundable. We recommend careful consideration of your requirements before selecting a payment plan.

Platform Accessibility

• Registration: To access the platform, all users must register using their real names and a valid email address. Any falsified information may result in immediate termination of access.
• Active Plan: To access user data and platform features, users must maintain an active subscription or license plan. Lapsed plans may result in restricted access or data removal.
• Data Removal: In cases of prolonged inactivity exceeding 60 days, we reserve the right to remove user data and content if deemed necessary for compliance or storage management.

Liability

• Automated Models: Any automated domain models or resource models created using the platform cannot be used for technical reports of mineral resources or mineral reserves unless thoroughly verified and validated by certified professionals. The platform is designed to support user customization and review, allowing geoscientists, geologists, and mining experts to adapt workflows and validate results independently.
• Algorithms and Services: APMT is fully responsible for the algorithms and software implementations provided on the platform, as well as ensuring the general availability of the Service. In the event of a service interruption, our team will strive to restore functionality as quickly as possible.
• Limitation of Liability: To the fullest extent permissible by applicable law, APMT shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenues, or business opportunities arising from:
  • i. Your use or inability to use the Service;
  • ii. Any unauthorized access to or use of our servers or personal information stored therein;
  • iii. Service interruptions, data loss, or data corruption;
  • iv. The conduct of third parties, including other users of the Service.

APMT disclaims any economic responsibility for any direct or indirect damages resulting from the use or misuse of platform features, algorithms, or data. Users assume full responsibility for understanding the foundational aspects of each method, algorithm, technique, and any other building blocks of the workflows provided within the platform. The platform is intended for expert users who are fully aware of the implications and outcomes of using these tools. APMT shall not be held liable for any misinterpretation, error, or unintended results arising from the use of the platform.

Responsibility for Misuse

Users agree not to misuse the platform by sharing sensitive information with other users or external parties, including but not limited to other individuals, companies, and governmental bodies, where such sharing may lead to data breaches or violations of privacy laws. APMT is not liable for any consequences that arise due to users' sharing of sensitive information or misusing the platform in any way.

Termination

We reserve the right to terminate or suspend your account and access to the Service at our sole discretion, without notice, if we believe your behavior violates these Terms, threatens other users, or risks legal liabilities. You may terminate your subscription at any time, but payments made prior to termination will not be refunded.

Changes to Terms

APMT reserves the right to modify these Terms at any time, with or without notice. Any updates will be communicated via email or by updating this page. Your continued use of the Service following the posting of changes constitutes your acceptance of the updated Terms.
